Terms of entry

PWR Ops Pty Ltd ACN 641 688 084 (and its related bodies corporate as defined under the Corporation Act 2001 (Cth)) (PWR) is committed to protecting the privacy of individuals and their personal information and complies with the Privacy Act 1988 (Cth) (Privacy Act). 

Please read this notice carefully as it will have important consequences for you in relation to the collection, use and disclosure of your personal information you provide to us.

PWR reserves the right to refuse and/or revoke entry to the experience. Persons who are under 15 years of age will only be admitted to the venue if they are accompanied by an adult. Merchandise is subject to availability.  No responsibility is taken for any loss or damage to you or your personal items. PWR may add, withdraw or substitute talent or teams in an experience and/or vary advertised material, prices and times without notice or liability to you.  To enter the venue all persons must submit to security screening and inspections where requested by PWR.

Privacy Collection Notification Statement

Without limiting the foregoing, you (and, if you are under 15 years of age, your adult guardian) understand that:

1.  PWR is the party that is collecting your personal information and can be contacted at PrivacyOfficer@LCLNGroup.com or alternatively you can write to PWR at LCLN Group, Suite 5, 120 Bluestone Circuit, Seventeen Mile Rocks Qld 4073.
2. PWR will collect your personal information directly from you at events or experiences, via its website, email or in a form in relation to registration to attend an event. 
3. PWR collects your personal information for the following purposes:
   • Event registration: to process your registration to attend an event; to process any enquiry you may have; and to provide you with information regarding your registration;
   • General marketing: for marketing and promotional activities by us (including by direct mail, social media, telemarketing, email and on PWR’s website) such as PWR’s email alerts, promotional videos, product awareness information and newsletters; to aggregate with other information and use it for marketing; to offer you updates on products, services, events or information that may be of interest to you;
   • Business purposes: for PWR’s marketing and customer base analytics; and for the maintenance and development of PWR’s products and services, business systems and infrastructure;
   • Competitions: to provide prizes to competition participants; and to contact you in relation to your entry, or let you know if you are a winner;
   • Surveys: to invite you to participate in voluntary surveys; and
   • Safety: to ensure public and staff safety; to verify any instances of breach of applicable laws or complaints, by way of video recording and image capture; to assist in the protection of PWR’s and visitors’ property.
4. You acknowledge and agree to your personal information being collected and used for, and in connection with, the purposes in paragraph 3 and any other purpose described in PWR’s Privacy Policy.
5. Given the means by which this personal information is being collected, it is not possible for you to use a pseudonym or otherwise keep your identity secret.
6. If PWR does not collect this personal information in connection with the purposes described in paragraph 3, then PWR may be unable to: permit you with entry to PWR’s events, premises or other locations controlled by PWR; and send you direct marketing communications (unless you have consented to such communications through other dealings with PWR).
7. PWR may disclose your personal information to the following classes of people and organisations in connection with the purposes in paragraph 3:
   • PWR's personnel;
   • PWR’s contractors, agents or third party providers who may assist PWR in providing PWR’s products and services to you, including but not limited to any marketing, security or IT service providers; 
   • in connection with the sale of any part of PWR’s business or a company owned by PWR;
   • the Everyone Project; and
   • any other organisation as expressly covered in PWR’s Privacy Policy.
8. It is possible that some of the information collected during the course of the event may be disclosed to PWR’s service providers outside of Australia.  You consent to your information being disclosed to a destination outside Australia for this purpose, including but not limited to the United States, and you understand and acknowledge that Australian Privacy Principle 8.1 will not apply to such disclosures of your personal information.
9. PWR’s Privacy Policy sets out the process as to how you can access and correct any of your personal information collected under this form as well as to how you can make a complaint if PWR has breached the Privacy Act in the handling of your personal information.  PWR’s Privacy Policy is available on PWR’s website at www.teampwr.gg or you may request a copy by contacting PWR at the details in paragraph 1 above.

By entering this experience, you acknowledge that you have read this collection notification and acknowledge that your personal information will be collected, used and disclosed in accordance with this collection notice and as otherwise detailed in PWR’s Privacy Policy and, to the extent it is necessary, you give your voluntary express consent to us collecting, using, storing, disclosing and disposing of your personal information in this manner. You also acknowledge that you may be filmed or photographed, and you consent to your voice, name and/or likeness being used, without compensation, in any and all media, whether now known or hereafter devised, for eternity, and you release PWR (or any of its employees, officers, agents, partners, contractors, affiliates or associates) from any liability whatsoever of any nature.

Limitation of Liability and Release

Except for any liability that cannot be excluded by law, in no event will PWR (or any of its employees, officers, agents, partners, contractors, affiliates or associates) be liable for any claims, damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of or in connection with the event.

You unconditionally and irrevocably indemnify and release PWR (and any of its employees, officers, agents, partners, contractors, affiliates or associates) from all actions, suits, claims, costs and demands which PWR (or any of its employees, officers, agents, partners, contractors, affiliates or associates) may incur in the course of or in connection with your entrance and participation in the event. Do not enter this area if you do not wish to be subject to these terms.

These Terms apply to any Competition operated by Operator and announced on Operator’s (or its associate’s) social media channels (Announcement) that make reference to these Terms.

This Competition is in no way sponsored, endorsed, or administered by, or associated with Twitter, Discord, YouTube or Epic Games Inc.

By entering into the Competition, you accept (and if you are under 18, you agree you have your guardian’s agreement on your behalf to) the following Terms which are final and binding on all matters relating to the Competition:

1. Definitions

Announcement has the meaning given to this term in the introduction paragraph, and can be (without limitation) in the form of Tweet, Discord announcement, Instagram post or Instagram story.

Competition means any game of chance or game of skill operated by the Operator pursuant to these Terms.

Competition Period has the meaning given to that term in Section 4.

Criteria means any criteria set out in the Announcement (eg. follow the Twitter account, like the Tweet and Retweet the Announcement).

Eligible Entrants has the meaning given to that term in Section 3.

Operator means PWR Ops Pty Ltd.

Prize means the prize or prizes specified in the Announcement, which in no case will exceed retail value of AU$10,000 in total.

Submission means any entry or content that an Eligible Entrant submits as part of their Competition entry.

Winners means Eligible Entrants who have been selected by the Operator as the successful participants in the Competition.

2. Operator

Operator is the entity operating this Competition.

3. Entry Requirements

To be eligible to enter this Competition, you must be 13 years or older. If you are under the age of 18, you must obtain, and you agree that you have obtained, the consent of your parent or guardian to enter into this Competition. This Competition is only open to entrants (Eligible Entrants) who:

1. reside in a country, state, province or territory in which these Terms are fully compliant with all applicable laws and regulations of that place and it is lawful for you to enter this Competition;
2. do not reside in a country under Australian sanctions, which include, for example, Central African Republic, Iraq and Democratic Republic of the Congo; and
3. do not reside in a country where Twitter, Discord, YouTube or Fortnite are not available or prohibited to use.

Employees, contractors and interns of Operator, their affiliates, associates and members of their immediate families are not eligible to participate or win. 

No purchase necessary to enter or win. 

4. Entry Period

The Competition will start on the date and time as set out in the Announcement (or if no time is specific, at the time of the Announcement) and end on the date and time as set out in the Announcement (Competition Period). Late entries will not be accepted.

5. Prize

Winners shall be awarded the Prize as per these Terms and the Announcement.

Prize are non-transferable and cannot be substituted for cash. Operator reserves the right to substitute a prize of equal or greater value.

6. How to enter

The process and conditions of entering the Competition will be set out in the Announcement. You must submit your Submission in accordance with the Announcement and these Terms in order for your entry to be eligible.

7. Submission Criteria

In addition to any specific requirement set out in the Announcement, submission must be given in accordance with these Terms and must:

1. be the original work of the Eligible Entrant and not infringe any intellectual property or other rights of any third party;
2. not be harassing or disrespectful in any way, nor include the use of abusive or offensive language/behaviour, game sabotage, spamming, social engineering, scamming, or any unlawful activity;
3. otherwise be appropriate to be displayed to all audiences including persons under the age of thirteen (13); and
4. must comply with the rules of any platform on which the Submission is made.

Unless otherwise specified in the Announcement, you may only enter once.  Any attempt by any person to obtain more than the permitted number of entries by any methods including, without limitation, duplicate accounts, related accounts or any automated or other means which subverts the entry process, will void all of that person’s entries and that person will be disqualified. Operator reserves the right to investigate and audit submissions.

If your Submission is posted on a platform, your account posting the Submission must be set to “public” in order for your entry to be eligible.

8. Winner Selection

Winners will be selected in a random drawing from all eligible entries received during the Entry Period, or in cases where the Criteria requires the exercise of skill, by Operator’s selection based on Criteria. The selection of Winners will take place in Melbourne, Australia at the offices of the Operator. All decisions of Operator are final and binding.

9.      Delivery of the Prize

Operator will contact each Winner on Twitter or Discord to: (a) confirm the Winner’s placement/prize; (b) if the Winner is under 18, collect acceptable evidence of parental/guardian consent to their entrance into the Competition; (c) ensure the Winner is an Eligible Entrant; and (d) provide adequate personal details to allow the Prize to be distributed to the Winner.  Each Winner will then have 48 hours to respond to Operator and provide the requested information and/or documents. If an inadequate response or no response is received, or the Winner is uncontactable, the prize may be revoked or redrawn (at Operator’s sole discretion). The Prize is not able to be substituted, transferred or assigned to any other person or entity without Operator’s prior written consent.

Should a Canadian resident be selected as a potential Winner, as a condition of being declared an official Winner and receiving any prize, such Canadian resident must first correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question via email or other means as determined by Operator in their sole discretion.

10. Licence

Except where legally prohibited, by entering the Competition, each Eligible Entrant (and, if a minor, Eligible Entrant’s parent or legal guardian) grants permission for Operator and its associates to use Submission, his/her name, user name, biographical information, address (city and state), photograph (including, but not limited to, profile photo), voice and/or other likeness and prize information for advertising, commercial and promotional purposes, in all media now known or hereafter discovered, in any manner, worldwide in perpetuity, without notice, review, approval or compensation. Where the Submission includes artwork, designs or other creative content, the Eligible Entrant also grants Operator a worldwide, perpetual, irrevocable, royalty-free licence to reproduce, modify, adapt, display, publish, distribute, sublicense and incorporate the Submission (in whole or in part) into Operator's games and related content, and to make such modifications as are reasonably required for artistic, technical or operational purposes.

11.    Exclusions

Operator is not responsible for any incomplete, inaccurate or improperly made entries to the Competition. Operator reserves the right to disqualify any and all entries which it considers (in its sole discretion): 

4. have been made by fraudulent or improper means;
5. use another person’s social post without their authorisation; 
6. use abusive or offensive language, or language which is not appropriate for Operator’s audiences including persons under the age of thirteen (13); 
7. does not comply with any applicable law or regulation, including without limitation, those governing copyright, content, defamation, privacy and publicity; 
8. infringes intellectual property rights and/or any other rights of any person or entity; or 
9. otherwise violates these Terms. 

Except for any liability that cannot be excluded by law, in no event will Operator (or any of its employees, officers, agents, contractors, affiliates or associates) be liable for any claims, damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of or in connection with the Competition or the Prize.

​​To the maximum extent permitted at law, the Prize is provided on an “as is” basis without warranty of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement.

13. Release and Indemnity

You acknowledge that this Competition is in no way sponsored, endorsed or administered by, or associated with, Fortnite, Epic Games, YouTube, Discord or Twitter. You release Fortnite, Epic Games, YouTube, Discord and Twitter from any and all claims which may arise in relation to this Competition.  Any questions or comments regarding the Competition must be directed to Operator, not Fortnite, Epic Games, YouTube, Discord or Twitter. You indemnify and release Operator, Fortnite, YouTube, Epic Games, Discord and Twitter from any and all claims, losses or liabilities which Operator, Fortnite, Epic Games, Discord or Twitter may incur in the course of or connection with your entrance and participation in the Competition.

14. Taxes and Expenses

All taxes associated with prize acceptance are the sole responsibility of the Winner. The Prize awarded will be inclusive of any taxes Operator is required by law to withhold or pay. 

In addition, the Winner will be responsible for paying all costs and expenses related to the Prize including but not limited to mobile phone service and other associated expenses.

15. Nature of Relationship

Each Eligible Entrant acknowledges and agrees that the relationship between the Eligible Entrant and Operator is not a confidential, fiduciary, or other special relationship, and that the Eligible Entrant’s decision to provide a submission to Operator for purposes of the Competition does not place Operator in a position that is any different from the position held by members of the general public with regard to their participation in the Competition. Each Eligible Entrant acknowledges and agrees that Operator does not now and shall not have in the future any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of the copyright in and to the submission.

16. Variation 

Operator may, in its absolute discretion, vary the Terms from time to time by publishing such varied Terms on the Website, any social media channel or by any other means.

17. Force Majure

If for any reason any aspect of this Competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of Operator, Operator may in its sole discretion cancel, terminate, modify or suspend the Competition and invalidate any affected entries, or suspend or modify a Prize.

1. advertise that the Competition has been canceled on Discord Server, Twitter, Website, or any social media channel;
2. destroy all Submissions received; and
3. not use personal information that any participant has provided to Operator.

In addition, if the Prize is unavailable, for any reason beyond Operator’s reasonable control, Operator may offer an alternative prize of equivalent value and specification (at its absolute discretion).

19. Waiver 

Failure by Operator to enforce any of its rights at any stage does not constitute a waiver of those rights.

20.     Severability 

If a provision of these Terms and conditions is illegal, invalid, unenforceable or void in a jurisdiction, it is severed for that jurisdiction and the remainder of these terms and conditions has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected.  This clause has no effect if the severance alters the basic nature of these terms and conditions or is contrary to public policy.

21. Applicable Law 

You agree that your rights and obligations under these Terms will be construed, take effect in accordance with and be governed by the laws of the State of Queensland, Australia, and you expressly submit to the exclusive jurisdiction of the Courts of Queensland, Australia and of all courts competent to hear appeals from them.

Collection Statement

As part of your entry to this Competition, you agree to your personal information being collected by Operator and used as per the following Collection Notification Statement:

1. Operator is the party collecting the information you provide to enter the Competition and to receive your Prize. You can contact us at privacyofficer@LCLNGroup.com.
2. Operator may use the details it collects from you, including any email address you give to us in relation to your participation in the Competition or distribution of the Prize:
   1. for your entry into the Competition; 
   2. for any promotional and publicity purposes; 
   3. to comply with any law (including with respect to taxation); and 
   4. to send you information and direct marketing communications about our products, services, events, offers or any other activities (including third party products, services, offers and events) which we consider may be of interest to you.
3. Some of the information we ask you to provide may be identified as mandatory or voluntary. If you do not provide the information required by these Terms or the information you provide is incorrect or incomplete then:
   1. we may not be able to accept your Competition entry, your entry may be disqualified, you will not be able to enter the Competition, or we may be unable to deliver your Prize if you are a winner; and 
   2. we will be unable to send you direct marketing communications (unless you have consented to such communications through other dealings with us).
4. We may disclose the information provided in your entry to the Competition (or the information you have provided after we have contacted you as a Prize winner) to third parties that are related to, or affiliated with, Operator, including but not limited to the distributor company we utilise to distribute your Prize (if you are a Prize winner).

By continuing with your entry into the Competition, you indicate that you have read this collection statement and acknowledge that your personal information will be collected, used and disclosed in accordance with this Collection Statement and, to the extent it is necessary, that you give your voluntary express consent to Operator collecting, using, storing, disclosing and disposing of your personal information in this manner.
