By entering into the Competition, you accept (and if you are under 18, you agree you have your guardian’s agreement on your behalf to) the following terms and conditions (Official Rules) which are final and binding on all matters relating to the Competition:
PWR Ops Pty Ltd (Operator) is the entity which is operating this Competition.
To be eligible to enter this Competition, you must be 13 years or older. If you are under the age of 18, you must obtain, and you agree that you have obtained, the consent of your parent or guardian to enter into this Competition. This Competition is only open to entrants who reside in a country, state, province or territory in which these Official Rules are fully compliant with all applicable laws and regulations of that place and it is lawful for you to enter this Competition (Eligible Entrants). Employees of Operator or Epic Games, affiliates, associates and members of their immediate families are not eligible to participate or win.
The Competition will start upon the Competition announcement on the “PWR Community Discord Server” or “@TeamPWR Twitter Account” (Operator Socials) and end once all 10 slots for the Stream Event (as defined below) are filled, or any other such time as may be, postponed, extended or shortened in the Operator’s absolute discretion as notified on the Operator Socials (Competition Period). Late entries will not be accepted.
The total prize pool of US$5,000.00 (Prize Pool) shall be distributed and portioned as follows:
The Winners will be responsible for payment of any expenses, duties and taxes with respect to the Prizes.
(Entry) To enter this Competition, an Eligible Entrant must:
(a) access the PWR “Going Up” Fortnite island (Game) using the Fortnite creative island code 2356-2884-5900;
(b) successfully complete the Game by winning on the wheel spin at the top of the course and take a screenshot of the code that is displayed upon completion (Screenshot); and
(c) submit the Screenshot on the “PWR Community Discord Server - Going Up Tournament - Screenshot Submission” thread.
Your account posting the Screenshot must be set to “public” in order for your entry to be eligible.
The Operator will then select 10 (ten) Eligible Entrants who have posted a Screenshot (Qualifiers) to play the Game in a 10-person tournament during a PWR live-stream event (Stream Event) where they will compete for the prizes and be awarded based on their placement in the Game.
During the Stream Event, Qualifiers who participate in the Stream Event (Winners) will be ranked by how far the Qualifier advances in the Game and ranked based on the Prize Pool portions in section 4 above. If two or more Qualifiers advance to the same point in the Game, those Qualifiers who reached that point first, will be awarded the higher position of the two (and the associated portion of the Prize Pool). If two or more Qualifiers reach the same point in the Game at the same time, at the Operator’s discretion the ranking will be decided by either, the Qualifiers re-starting the Game from the beginning, or a coin flip.
You may only enter once. Any attempt by any person to obtain more than the permitted number of entries by any methods including, without limitation, duplicate accounts, related accounts or any automated or other means which subverts the entry process, will void all of that person’s entries and that person will be disqualified.
The Operator will choose the Qualifiers who will participate in the Stream Event based on the creativity of the Screenshot and the accompanying caption with the Screenshot. The final distribution of prizes among the Qualifiers will be determined by their placement in the Game during the Stream Event.
The Operator will contact each Qualifier and Winner on Twitter or Discord to: (a) confirm the Winner’s placement/prize; (b) if the Winner is under 18, collect acceptable evidence of parental/guardian consent to their entrance into the Competition; (c) ensure the Winner is an Eligible Entrant; and (d) provide adequate personal details to allow the Prize to be distributed to the Winner. Each Winner will then have 48 hours to respond to the Operator and provide the requested information. If an inadequate response or no response is received, or the Winner is uncontactable, the prize may be revoked or redrawn (at the Operator’s sole discretion). Prizes are not able to be substituted, transferred or assigned to any other person or entity without Operator’s prior written consent.
Except where legally prohibited, by entering the Competition, each Eligible Entrant (and, if a minor, Eligible Entrant’s parent or legal guardian) grants permission for Operator and its associates to use Screenshot, his/her name, user name, address (city and state), photograph (including, but not limited to, profile photo), voice and/or other likeness and prize information for advertising, commercial and promotional purposes, in all media now known or hereafter discovered, in any manner, worldwide in perpetuity, without notice, review, approval or compensation.
Operator is not responsible for any incomplete, inaccurate or improperly made entries to the Competition. Operator reserves the right (at any time before or after the Winners are selected) to disqualify any and all entries which it considers (in its sole discretion):
(d) have been made by fraudulent or improper means; (e) use another person’s Screenshots without their authorisation; (f) use abusive or offensive language, or language which is not
appropriate for Operator’s audiences including persons under the age of thirteen (13); or
(g) otherwise violates these Official Rules.
Operator is not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Competition. Should any portion of the Competition be, in Operator’s sole opinion, compromised, corrupted or interfered with in any way, Operator reserves the right at its sole discretion to suspend or terminate the Competition.
In no event will Operator or Epic Games (or any of their employees, officers, agents, contractors, affiliates or associates) be liable for any claims, damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of or in connection with your entrance to this Competition.
You acknowledge that this Competition is in no way sponsored, endorsed or administered by, or associated with, Fortnite, Epic Games, Discord or Twitter. You release Fortnite, Epic Games, Discord and Twitter from any and all claims which may arise in relation to this Competition. Any questions or comments regarding the Competition must be directed to the Operator, not Fortnite, Epic Games, Discord or Twitter. You indemnify and release Operator, Fortnite, Epic Games, Discord and Twitter from any and all claims, losses or liabilities which the Operator, Fortnite, Epic Games, Discord or Twitter may incur in the course of or connection with your entrance and participation in the Competition.
11.Variation
The Operator may, in its absolute discretion, vary the Official Rules from time to time by publishing such varied Official Rules on the Operator Socials by any means.
If for any reason any aspect of this Competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of Operator, Operator may in its sole discretion cancel, terminate, modify or suspend the Competition and invalidate any affected entries, or suspend or modify a prize.
Failure by the Operator to enforce any of its rights at any stage does not constitute a waiver of those rights.
If a provision of these terms and conditions is illegal, invalid, unenforceable or void in a jurisdiction, it is severed for that jurisdiction and the remainder of these terms and conditions has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected. This clause has no effect if the severance alters the basic nature of these terms and conditions or is contrary to public policy.
You agree that your rights and obligations under this Competition will be construed, take effect in accordance with and be governed by the laws of the State of Queensland, Australia, and you expressly submit to the exclusive jurisdiction of the Courts of Queensland, Australia and of all courts competent to hear appeals from them.
As part of your entry to this Competition, you agree to your personal information being collected by Operator and used as per the following Collection Notification Statement:
(a) Operator is the party collecting the information you provide to enter the Competition and to receive your prize. You can contact us at privacyofficer@LCLNGroup.com.
(b) Operator may use the details it collects from you, including any email address you give to us in relation to your participation in the Competition or distribution of the Prize: (i) for your entry into the Competition;
(ii) for any promotional and publicity purposes;
(iii) to comply with any law (including with respect to taxation); and
(iv) to send you information and direct marketing communications about our products, services, events, offers or any other activities (including third party products, services, offers and events) which we consider may be of interest to you.
(c) Some of the information we ask you to provide may be identified as mandatory or voluntary. If you do not provide the information required by these official rules or the information you provide is incorrect or incomplete then:
(i) we may not be able to accept your Competition entry, your entry may be disqualified, you will not be able to enter the Competition, or we may be unable to distribute your prize if you are a winner; and
(ii) we will be unable to send you direct marketing communications (unless you have consented to such communications through other dealings with us).
(d) We may disclose the information provided in your entry to the Competition (or the information you have provided after we have contacted you as a Winner) to third parties that are related to, or affiliated with, Operator, including but not limited to the distributor company we utilise to distribute your prize (if you are a winner).
By continuing with your entry into the Competition, you indicate that you have read this collection statement and acknowledge that your personal information will be collected, used and disclosed in accordance with this Collection Statement and, to the extent it is necessary, that you give your voluntary express consent to Operator collecting, using, storing, disclosing and disposing of your personal information in this manner.
